OPEN MEETING: Supervisor Thomas Gale called a special meeting of the Milford Town Board to order at 5:08 pm at the Town Hall in Portlandville. The purpose of the special meeting was for decisions to be made concerning the resignation of the Town Tax Collector and the new dog law for the town which is titled proposed Town of Milford Local Law #1 of 2010.
ROLL CALL: Present were Supervisor Thomas Gale, Councilmen John Gill, Karl Vogel and Harold Couse; Town Clerk Kenneth C. Sosnowski and a concerned townsperson. Councilman Olin Waters was absent.
The resignation letter of Town of Milford Tax Collector Jose Martinez was read by the Town Clerk. Councilman Couse, seconded by Councilman Vogel made the motion to accept the resignation. Vote: All Ayes.
The Town Supervisor wanted to appoint Debi Cotten to fill the unexpired term of tax collector to take effect immediately. Councilman Gill, seconded by Councilman Vogel made the motion. Vote: All Ayes.
Proposed Town of Milford Local Law No. 1 of the Year 2010, A Local Law for the Licensing and Control of Dogs in the Town of Milford was discussed. All board members were provided with a copy of the proposed law before hand. There is a proposed separate fee schedule.
The Town Supervisor, seconded by Councilman Couse made the motion to hold a public hearing concerning the proposed dog law December 16, 2010, at 6:30pm. Vote: All Ayes.
The Town Supervisor, seconded by Councilman Couse made the motion to hold an End of Year Meeting for the purpose of paying bills December 30, 2010, at 6 pm. Vote: All Ayes.
Motion to adjourn was made by Councilman Couse, seconded by Councilman Vogel at 5:23pm. Vote: All Ayes.

PUBLIC HEARING—ON THE PROPOSED TOWN OF MILFORD
LOCAL LAW No. 1 OF THE YEAR 2010

The public hearing on the Town of Milford Local Law No. 1 of the year 2010 - A LOCAL LAW FOR THE LICENSING AND CONTROL OF DOGS IN THE TOWN OF MILFORD, was opened at 7:07 pm by Supervisor Thomas Gale. The following persons were also present: Councilmen John Gill, Karl Vogel, and Harold Couse; Highway Superintendent Richard Atwell; Town Clerk Kenneth Sosnowski and several townspersons. Councilman Olin Waters was absent
Supervisor Gale advised the public that as of January 1st, 2011, individual towns will be responsible for the licensing and control of dogs in their respective towns and that New York State Agriculture and Markets would no longer oversee dog licensing. He advised the proposed Local Law No. 1 of 2010 had been previously handed out to the Councilmen and that the law had been drafted by the Town Clerk in cooperation with the Town Attorney.
The Town Clerk advised that the law replaced and was a codification of all prior Town of Milford dog control laws, that fees would remain at the existing level and the dog fee schedule would be separate from the proposed law. The Town Clerk was commended for his work.
OPEN FLOOR:
- Concerned townspersons inquired how the people would be made aware of the new law and were advised by posting at the town hall and publishing, if possible, on the county website.
There were no further questions pertaining to the new dog law.
The Town Supervisor seconded by Councilman Couse recommended the hearing closed. 7:14pm.

December 16, 2010 – MINUTES

OPEN MEETING: Supervisor Thomas Gale called the regular monthly meeting of the Milford Town Board to order at 7:15 pm at the Town Hall in Portlandville.
ROLL CALL: Present were Supervisor Thomas Gale, Councilmen John Gill, Karl Vogel and Harold Couse; Highway Superintendent Richard Atwell, Town Clerk Kenneth C. Sosnowski and concerned townspersons. Councilman Olin Waters was absent.
MOTIONS:
A motion to accept the Monthly Financial Statement of the Town Supervisor for November 2010 was made by Councilman Vogel seconded by Councilman Gill. Vote: All Ayes.
A motion to accept the 2011 Town of Milford Budget Meeting Minutes of November 4, 2010, was made by Councilman Couse seconded by Councilman Vogel. Vote: All Ayes.
OPEN FLOOR:
- Sally Barlow served a FOIL request on the Town Supervisor requesting information on the $10,300 FEMA funds for the 2006 flood and disposition of the money. Specifically requested was a copy of the Town of Milford’s proposal submitted to FEMA for cleaning 400 feet of Barlow (Redwing) Creek, and the letter from FEMA requesting that the Town of Milford return the funds ($10,300). The Town Supervisor directed the Highway Superintendent to provide the P4. Pat Barlow stated they were not notified of FEMA money. Highway Superintendent advised the landowner was usually notified. Also advised the money went to the town and the town did the work. Sally again stated they were not notified and wanted to work more closely with the town if another disaster struck. Sally advised the FEMA money was for 400 feet of work and the DEC permit was for 1000 feet of work. She advised they had a permit to do the work and complained that it must have been a town official that called DEC was called complaining they were doing the work. Sally advised they paid a private contractor out of packet for the work. The Highway Superintendent advised that FEMA would not reimburse a private person, that it was ridiculous the amount FEMA set aside for a job especially for 400 feet of work for $10,300 and that he reported to FEMA that the work had already been done on Redwing Creek.
- Vince Stayter served a FOIL request on the Town Supervisor on behalf of the GYLA for ECO reports which should be on file. He advised that the ECO reports were inadequate in that they did not specify location, type of violation or the name of the property owner. He asked why it was handwritten and hard to read and the Town Supervisor advised him that was how the ECO did his reports and he saw no problem with it. He asked why there were no names in the reports and the Town Supervisor advised that the cases were not in court yet and they were innocent until proven guilty. He stated there was no indication of location and the Town Supervisor said ‘OK’. He advised the Town Supervisor that if there was a citation it was public domain with names and addresses and he felt the Town Supervisor was going out of his way to keep the information from the public. The Town Supervisor advised he could not see the need for the public to know. Vince offered to write a data base for the town free for reports, citations and the tracking of complaints.
- Vince Stayter wanted to set up a meeting with the GYLA and the ECO to discuss problems and the Town Supervisor said excellent. He also wanted two members of the board to walk with the GYLA to see what they saw especially on Maple Street.
HIGHWAY SUPERINTENDENT’S REPORT: Superintendent Atwell reported on the following:
q HIGHWAY INVENTORY – Completed and handed in.
q DISASTER PLAN – Lyle Jones of the Otsego County Office of Emergency Services has put a disaster plan together for mutual aid between the towns. A copy was made by the County Attorney and the Otsego County Highway Superintendent’s Association supports the mutual aid agreement. The Town Supervisor directed the agreement to the Town Attorney.
q WINTER WEATHER – there were some minor breakdowns but no major problems with equipment.
q 2004 F-350 FORD PICKUP – there were no bids. Recommended running the notice in a couple of months and to leave the ‘For Sale’ sign on the truck. The earliest auction is in April.
- Concerned townsperson Lori Solensten asked what written road use requirements the Town of Milford had and was advised just seasonal, nothing to do with truck traffic. She asked if the town received a notice to attend the Otsego County meeting on truck traffic and was advised it did not. She advised the County Representative was to notify the town and she would find out why not.
TOWN SUPERVISOR’S COMMUNICATIONS: Supervisor Gale reported on the following:
q Time Warner Cable – has provided a current programming list which will be posted and 2011 price information.
q Public Service Commission – sent information on home heating and how to better handle energy bills.
q Tax Collector’s Computer/Printer – has been programmed. Thank you to Bernie Atwell who was a big help to the town. Jose Martinez resigned and Debi Cotton was appointed to fill the unexpired term as the Town of Milford Tax Collector. Her membership on the ZBA will be handled later. Any questions concerning money will be turned over to the insurance company.
q MOSA – tipping fees were reduced by 35%.

The Town Supervisor advised Resolution 21-10 passed.
Building Repairs – two proposals were received for repair of the 2857 property - the chimney, metal roof and eaves need repair and the right side front porch needs to be removed. Paul Fish’s proposal was for $2300 and Caveman Construction was for $9100.
Motion: A motion was made by the Town Supervisor seconded by Councilman Gill to accept the repair proposal of Paul Fish if it could be done in 30 days. Vote: All Ayes.
The Highway Superintendent asked how much the Town Supervisor was going to put into the house (2857 St Hwy 28) and was advised $30,000. The Highway Superintendent asked about raises for all highway employees instead of putting money into the house and asked what if the CHPs money dried up and road work was needed, what would the Town Supervisor do then? The Town Supervisor advised he would take care of the roads first and the house second. The Highway Superintendent wanted a financial report every month on what was spent out of the highway accounts and the Town Supervisor agreed. The Highway Superintendent blamed the Town Supervisor of taking money out his DB budgeted account. Coyne Textiles should be taken out of the safety account and not the DB account.
Town Hall - chimney needs repair.
Motion: Councilman Couse seconded by Councilman Gill made the motion to authorize the expenditure of $250 to Caveman Construction if they could repair the chimney within the week. Vote: All Ayes.
Generator Cover – Zido Electric repaired the cover and the bill was sent to All State Insurance. It has not been inspected and the town will not pay until it is inspected. The Town Supervisor wanted the Building Committee to look into a protective cover for the generator for snow and ice and plowing.
Internet at the Town Barn – the Town Supervisor advised he sent the paperwork to Time Warner.
NEW BUSINESS:
A complaint concerning the Dog Control Officer was read into the minutes by the Town Clerk. He called 911 to find out why Deputy DCO Julie Polulech was called by 911 instead of DCO Jamie Waters to pick up a dog and was advised that he does not return his calls. Complaint placed in file.
Motion: Councilman Couse seconded by Councilman Gill made the motion to accept the updated Town of Milford Fee Schedule effective date. Vote: All Ayes.
Resolution 22-10: The Town Supervisor seconded by Councilman Couse made the motion to accept the new Town of Milford Dog License and Fee Schedule effective January 1, 2011, referencing Local Law #1 of 2010.

At 9:10pm, the Town Supervisor seconded by Councilman Gill made the motion to enter into Executive Session on the Collective Bargaining Agreement.
At 9:30pm, the Town Board returned from Executive Session.

ROLL CALL: Present were Supervisor Thomas Gale, Councilmen John Gill, Olin Waters, Karl Vogel and Harold Couse; Highway Superintendent Richard Atwell, Town Clerk Kenneth C. Sosnowski and concerned townspersons.
There were no bids on the 2004 Ford F-350 truck.
MOTIONS:
A motion to accept the Milford Town Board Meeting Minutes of October 21, 2010, was made by Councilman Couse seconded by Councilman Waters. Vote: All Ayes.
A motion to accept the Monthly Financial Statement of the Town Supervisor for October 2010 was made by Councilman Vogel seconded by Councilman Waters. Vote: All Ayes.
A motion to accept the 2011 Tentative Budget Meeting Minutes of October 5, 2010, was made by Councilman Gill seconded by the Town Supervisor. Vote: All Ayes.
A motion to accept the 2011 Preliminary Budget Hearing Minutes of November 4, 2010, was made by Councilman Waters seconded by Councilman Vogel. The following amendments were noted: The reserve fund was $40,000 not $50,000. The Town owned and maintained the street lights of the Town as per rule of the NYS PSC. The Supervisor’s Monthly Financial Statement does show balances per A, B, DA and DB as per law. The Town contributed to the Milford Library until it became a tax issue with the Milford School. Life Insurance A9045.8 covers the Highway Supervisor not the employees. Councilman Vogel seconded by Councilman Waters made a motion to accept the minutes with the aforementioned amendments. Vote: All Ayes.
OPEN FLOOR:
- There were numerous citizens concerned with the natural gas drilling going on specifically at the Ross well on the Crumhorn and with proposed gas drilling and hydro-fracturing in the Town of Milford. The citizens were concerned with water quality, roadway use, the state moratorium and what the Town could do to regulate the drilling companies in terms of environmental impact. In general it was recognized that the proposed moratorium by NYS and the DEC on gas drilling had not yet been passed by the Assembly. The DEC lacked the money to do testing and towns could not pass laws against drilling. The towns could control the use of roads but it would be difficult to prove the roads were damaged by the drilling trucks since other trucks use the roadways such as milk tankers, logging and fuel vehicles. Scott Brady from the Crumhorn Mountain Boy Scout Camp was concerned with gas drilling, heavy road use and hydro-fracking and handed the Town Board a resolution by the Town of Middlefield. Lucille Wiggins advised that there would be a meeting Monday on 11/22/2010, at 6pm at the Meadows concerning the Otsego County survey for roads. She also provided a handout. The Town Supervisor advised that a prior estimate was given for $8000 per town for the survey. He wanted the Highway Committee and Highway Superintendent to attend if possible. Other concerns discussed were designated routes for gas drilling trucks (the Town Highway Superintendent has spoken to the company four times and feels they would not be honest using designated routes), an Ad Hoc town committee to get people to think pro-actively about drilling, spills and county response with EMTs and Hazmat Team, Department of Health water testing and proving contamination came from drilling, how loud fracking was and taking a position with an ordinance to stop truck traffic (difficult because it could not be exclusive).
- Vince Stayter advised that the ECO report was inadequate in that it did not specify location, type of violation or the name of the property owner. He advised it was handwritten and hard to read. He provided the board with concerns from the GYLA which will be filed by the Town Clerk
- Art Henry commended the Highway Superintendent for leveling off the brush at the Crumhorn dump area and asked why it was closed off. After discussion the Highway Superintendent advised that he could not control who dumped there (shingles, vinyl siding, rugs, plastic bags, tires) even if the GYLA provided some patrols and that there was a drainage problem. He was concerned with a DEC inspection since there was more than leaves and branches dumped there.
HIGHWAY SUPERINTENDENT’S REPORT: Superintendent Atwell reported on the following:
q HUGHSON AND BENSON INSURANCE – Dallas Gedney inspected the truck equipment at the town barn and provided correct specifications.
q SHALE BANK – garbage is being dumped at the shale bank besides tree and shrub waste and it won’t burn and is filling up the bank. The Highway Superintendent wanted the Town Board to determine if the GYLA could use the bank and decide on any parameters for use. The Town of Milford has no dump and will dump trees at the bank but that was all.
q FIRST SNOW – the new truck is working good and there were no problems.
q 2004 F-350 FORD PICKUP – there were no bids. Recommended running the notice to bidders again and rewording it with no minimum bid.
MOTIONS:
The Town Supervisor seconded by Councilman Couse seconded made the motion to post the shale bank ‘No Unauthorized Personnel’. Vote: All Ayes.
Councilman Couse seconded by Councilman Vogel made the motion to again place the 2004 F-350 Ford pickup with plow up for bid with no minimum bid, run the bid notice for three days, open any bids at the next regular board meeting and to have the Town Clerk publish a notice to bidders. Vote: All Ayes.
TOWN SUPERVISOR’S COMMUNICATIONS: Supervisor Gale reported on the following:
q Holiday Decorations – thank you to the Highway Department for putting up the decorations.
q Time Warner – has provided a current programming list which will be posted.
q Snow and Ice Contract – sent into the county and copies received.
q Otsego 2000 – letter concerning drilling and hydro-fracking. Looking to the county for leadership since the State and DEC is not leading. They consider agricultural land as sacred. Letter to be posted and filed.
q MOSA – letter concerning a pilot program for electronic waste recycling was sent and is to be posted and filed.
q Dryden Mutual – inspected property at 2857 and recommended that the chimney, metal roof and eaves be repaired and the right side front porch be removed. The Building Committee was tasked to get proposals.
q Otsego County Code Enforcement – conducted a fire inspection of the town hall and will be notified when violations are completed.
q Catskill Center for Independence – The Town Supervisor advised that a monthly booklet was received and land use class is listed for 12-16-2010.
q Adirondack – Appalachian Regional Medical Emergency Services Council sent a letter required by Sect 3008 NYS Public Health Law that the City of Oneonta Fire Department has submitted an application to expand the area of their ambulance service.
Resolution 19-10: The Town Supervisor made a motion rescinding Resolution 17-10 Standard Work Day and Reporting Resolution seconded by Councilman Waters and replacing it with a new Resolution 19-10 Standard Work Day and Reporting Resolution - to establish six (6) hours per day as the standard work day to be reported on the Standard Work Day Reporting Resolution and such resolution is to include the last 4 digits of the member’s SSNs, the member’s retirement registration numbers, whether the member participates in the employer’s time keeping system and the actual number of days worked per month for the three (3) month report period.

Resolution 20-10: 2011 Fire Protection and Emergency Ambulance/Rescue Contract. The Town Supervisor seconded by Councilman Waters made a motion for the Town of Milford to enter into and approve the 2011 Fire Protection and Emergency Ambulance/Rescue Contract with the Village of Milford.

A motion was made by Councilman Waters seconded by Councilman Gill to hold a Holiday Open House on 12-19-2010 at the Town Hall in Portlandville, from 7 to 8:30pm.
A motion was made by Councilman Couse, seconded by Councilman Waters to spend $200 for food prior to the audit for the open house. Vote: All Ayes.
A motion was made by Councilman Gill seconded by Councilman Vogel to expend $750 on a lap top computer and software for the 2011 tax collector. Vote: All Ayes.

2011 PRELIMINARY BUDGET HEARING
November 4, 2010 – MINUTES

OPEN MEETING: Supervisor Thomas Gale called the 2011 Preliminary Budget Hearing with the Milford Town Board to order at 7:01 pm at the Town Hall in Portlandville.
ROLL CALL: Present were Councilmen John Gill, Harold Couse and Karl Vogel; Town Supervisor Thomas Gale; Town Clerk Kenneth Sosnowski and concerned taxpayers. Councilman Olin Waters was absent.
PROCEDURE: The Supervisor presented the 2011 preliminary budget to the town board. The Town Supervisor read the preliminary budget line by line and page by page, explaining the 2011 budget to the Town Board. He advised that he would be getting a stipend of $350 per month as Budget Officer, explained the contingency account, that the CHPs payments were low and that the town’s portion of county sales tax money went into roadway maintenance. He summed up the 2011 preliminary budget as follows:

less total estimated revenue = $ 404,543
less total unexpended balance = $ 274,350
total amount to be raised by taxes = $ 413,006 giving a tax of $2.51/$1000
The Town Supervisor explained that fire protection for the town increased
Concerns from the floor:
- Village of Milford Mayor Sabine Curry asked how many street lights were in the 3 areas of the Town of Milford since the Village had 12 lights and paid $7200/year. The Town Supervisor did not know but advised that NYSEG was the supplier and that the town owned the lights and had to maintain them.
- Taxpayers wanted the unexpended balance explained, wanted to know how it was estimated, whether it included the prior years balance and whether the unexpended balance was a real figure. The Town Supervisor explained the unexpended balance came from allocated money that was not spent, it was estimated for 2011 by looking at total expenditures for 2010 and estimating what further expenses there were for the year and that the prior years balance could be used to estimate the unexpended balance. He explained the money carried over was used against the budget and that by the end of the year the unexpended balance was as real a figure as possible.
- Art Henry asked if the employee benefits under DA and DB shouldn’t be added together. The Town Supervisor advised that they were two separate funds.
- Vera Sosnowski asked to have CHPs explained. The Town Supervisor explained that it was a fund to assist in the cost of road maintenance for the town and became available at the end of the year.
- Jim Havener asked about the reserve fund, how much was in it, and if it was used in the new budget. The Town Supervisor explained that there was $50,000 in the fund and that it was designated for re-evaluation purposes. Mr. Havener then asked that if the board knew of a re-evaluation wouldn’t it be prudent to increase the fund to mitigate the cost of the re-evaluation. The Town Supervisor explained that he has tried to do that when possible but not at the expense of increasing taxes. Mr. Havener wanted to know when the reserve fund was used and was told it has not been used since it was started in 2006 for re-evaluation. A reserve fund was set up for purchasing a new truck for the Highway Department and was used specifically for that purpose.
- Mayor Curry wanted to know what happened to surplus money in the town. The Town Supervisor explained that the unexpended balance used this year was not a surplus but used toward the next year’s budget. He explained money left over from the year before was rolled over into the unexpended balance for the next budget, the unexpended balance from 2009 was rolled over into the 2010 budget and the unexpended balance from 2010 was to be rolled over into the 2011 budget.
- Vince Stayter wanted an explanation of the contractual expenses under the budget and the Town Supervisor advised it was for a $350 per month stipend issued to himself to do the Budget Officer’s duties. Mr. Starter advised that under Town Law, Sect. 18.1, town officials couldn’t approve their own contractual expense and pay themselves. Other taxpayers wanted to know why this money was not claimed as a salary and wanted to know why the Supervisor was paying himself for doing these duties for which he already received a salary. The Town Supervisor told the taxpayers that he would continue to give himself a contractual salary as Budget Officer for which he gave himself a 1099 form and that he did not have to make that amount public as a salary. He advised that most town supervisors did this and that State Audit and Control advised him that it was OK to do.
- Mayor Curry and Vera Sosnowski advised that there appeared to be contractual expenses mixed in with salaries and the Town Supervisor advised that the State said he could.
- Joan Crippen asked if the Town Supervisor submitted a monthly financial report and if it included a balance by department. The Town Supervisor advised he issued a monthly report and it did not have departmental balances.
- Jim Havener wanted to know if the Board saw what was spent per coded item in the budgeted areas and was advised it was not broken down but listed generally under the main funding codes A, B, DA and DB.
- Francine Stayter asked if there were a data base for contractual expenses where salary items were itemized and was told no, entries were made on a hand written sheet.
- Vince Stayter asked if any thing was allocated to the Milford Library and was told no, that the library said it was not needed.
- Mayor Curry and Vince Stayter asked about employee benefits and were advised Hospitalization and Medical Ins. (A9060.8) covered the Highway Superintendent, State Retirement (A9010.8) covered the Town Supervisor, Highway Superintendent and Councilman Couse, Social Security (A9030.8) was for all employees, Life Ins. (A9045.8) covered highway employees and Disability Ins. (A9055.8) covered the custodian, ZEO and Environmental Officer etc.
The Town Supervisor called the hearing closed at 8:40pm.

OPEN MEETING: Supervisor Thomas Gale called the regular monthly meeting of the Milford Town Board to order at 7:01 pm at the Town Hall in Portlandville.
ROLL CALL: Present were Supervisor Thomas Gale, Councilmen Olin Waters, Karl Vogel and Harold Couse; Highway Superintendent Richard Atwell, Town Clerk Kenneth C. Sosnowski and concerned townspersons. Councilman John Gill was absent.
MOTIONS:
A motion to accept the Milford Town Board Meeting Minutes of September 16, 2010, was made by Councilman Waters seconded by Councilman Couse with the addition that Councilman Vogel was absent for personal reasons. Vote with addition: All Ayes.
A motion to accept the Monthly Financial Statement of the Town Supervisor for September 2010 was made by Councilman Waters seconded by Councilman Vogel. Vote: All Ayes.
OPEN FLOOR:
- The Town Supervisor apologized for getting the 2011 Preliminary Budget out late, advised it would be the same as the 2011 Tentative Budget and stated it would be out Tuesday.
- Vagliardo Inspection Service – Mr. Vagliardo was not present to give his report but the 2857 St Hwy 28 house inspection report was received and given to the Town Clerk for filing.
HIGHWAY SUPERINTENDENT’S REPORT: Superintendent Atwell reported on the following:
q CHPs – the paperwork was sent in August 22, 2010 and the town should see CHP funding in the amount of $106,169.45 in December.
q SEASONAL ROADS – Hotaling Road, State Land Roadand Sherman Roadwill have no maintenance from 12/01/2010 to 04/30/2011. A notice need will be sent to the Daily Star by the Town Clerk.
q FEMA – a letter from FEMA was received concerning a $10,300 check sent to the town for work to be done on Barlow Creek as a result of the 2006 flood. The project was never done and FEMA wants the money returned.
q 2004 F-350 FORD PICKUP – recommend putting the truck with attached plow up for bid. It has close to 90,000 miles and is a diesel. Recommend a minimum bid of $12,000.
q GRAVEL BANK – a permit has been received extending the gravel bank 2.6 acres and will have to be renewed in 2013.
q WORK TO BE DONE – putting trucks together for snow. They are not ready yet but will be in the next couple of days. The county will have all the rest of the sand in shortly.
q CONTROL OF SNOW AND ICE CONTRACT FOR 2011 – received from the county and needs a resolution for agreement.
MOTION: Councilman Couse seconded by Councilman Waters made the motion to place the 2004 F-350 Ford pickup with plow up for bid and to have the Town Clerk publish a notice to bidders. The bidding is to be by sealed envelope and all bids are to be received at the time of the next regular board meeting. Vote: All Ayes.
TOWN SUPERVISOR’S COMMUNICATIONS: Supervisor Gale reported on the following:
q Equalization Rate – the equalization rate is at 54%.
q Time Warner – has provided a current programming list which will be posted.
q Otsego County Board of Elections – voting machine drop off and pick-up scheduled for November 1st and 3rd 2010.
q Teamsters Local Union 182 – a date has to be set to begin Article 30 negotiations.
q Goodyear Lake Hydro Electric Project – Jerry Stevens and dam personnel met with some Mitigation Team members and GYL residents concerning an emergency action plan for evacuation on October 20, 2010. It was a good meeting and many questions concerning the dam were answered.
q Town 2011 Fire Protection Contract – sent to the town attorney.
q NYSEG – the NYS Public Service Commission approved new rates for NYSEG. The town now owns the poles and lights and is responsible for maintaining them. The town will continue pay the service charge for the lighting.
q Catskill Center for Independence – The Town Supervisor advised that a monthly booklet was received concerning building safety and articles for those who need special items. A copy is to be posted.
q Environmental Control Officer Report – has been received and will be placed on file with the Town Clerk.
q Complaint Letter from Mary Buck – the complaint made by Mary Buck was that the Dog Control Officer was not answering her complaint. The DCO had contacted one of her tenants Morse about dog registration and could not find the other tenant Hunt. Mary Buck complained about her HUD tenants and wanted them removed. She was advised that her problems with her tenants should be taken to HUD or the Sheriff’s Department and tenants were not the problem of the DCO or the town.
q 2011 Preliminary Budget Meeting - scheduled for November 4, 2010 at 7pm. Notice to be made by the Town Clerk.
q Benson Agency – the Town Supervisor advised he was meeting with the Benson Agency concerning truck insurance and requested permission to pay the insurance bill before the next meeting.
MOTION: Councilman Waters seconded by Councilman Vogel made a motion allowing the Town Supervisor to pay the Benson Agency insurance bill on the town trucks before the next meeting. Vote: All Ayes.
RESOLUTION 18-10: The Town Supervisor proposed entering into a one year Agreement for the Control of Snow and Ice on County Roads for 2011 effective October 21, 2010, beginning January 1, 2011 to December 31, 2011. Roll Call Vote: Councilman Waters – Aye, Councilman Vogel – Aye, Councilman Couse – Yes, Town Supervisor Thomas Gale – Aye. The Town Supervisor advised the resolution passed.
NEW BUSINESS:
Councilman Couse will look into a wireless internet service for the Town Barn. He advised he got 5 bars on his 4G wireless at the Town Barn and that the cost was $205 to set up and $40/month after. He advised he could get the system from Radio Shack and would need to set up an account for monthly billing and it would be a two year contract.
MOTION: A motion was made by Councilman Couse, seconded by Councilman Waters to spend $205 for equipment and setting up a wireless internet at the Town Barn and spending $40/month thereafter. Vote: All Ayes.
Smoke Detector – The Town Supervisor asked Councilman Couse to get with Councilman Gill to put together a package of options on a fire/burglar alarm system for the town hall.
Zoning Officers Report – A third quarter report was received and will be placed on file by the Town Clerk.
MOTION TO PAY BILLS: A motion to authorize payment of the following bills was made by Councilman Vogel seconded by Councilman Waters. Vote: All Ayes.
General Fund -- vouchers 284 to 310 for $11817.63
Highway Fund -- vouchers 120 to 133 for $43169.15
Lighting Fund -- voucher 10 for $120.36
ADJOURNMENT: A motion to adjourn was made by Councilman Couse seconded by Councilman Waters. Vote: All Ayes. 7:43pm.

PUBLIC INFORMATION HEARING—LOCAL LAWS NO. 1 & NO. 2

The Public Information Hearing on proposed Local Law No. 1 of the Town of Milford for 2009 regarding Town of Milford Short Term Transient Rental Regulations was opened at 7:02 pm by Town Supervisor Thomas Gale. Councilmen John Gill, Karl Vogel and Harold Couse; Town Clerk Kenneth Sosnowski, Planning Board Chairman Bruce Milavec, Vice Chairman Gary Wickham, Town Attorney Eric Jarvis and Zoning Enforcement Officer Kenneth Stone were also present. Councilman Olin Waters was absent. There were numerous townspersons in attendance. The Town Clerk read the legal ad for proposed Local Law No. 1 and Local Law No. 2, which was also posted in the 3 Post Offices and the Town Hall.
Town Supervisor Gale read the proposed Local Law No. 1 and advised that the purposes of the proposed law were 1) to bring all residences old and new up to the same level of compliance and 2) to ensure health and safety standards. He then invited the attending townspersons to respond with their concerns which were summarized as follows:
- the reasons for passing the law at this time was for fire, health and safety standards
- size requirements for bedrooms and if it would result in de-certification
- local managerial issues for emergencies and resolving complaints
- parking plans of 10 by 20 per space or ease of entry/departure from driveways
- grandfathering older residences in the town for STTR compliance
- posting the permit in a front window or door verses security
- compliance with the proposed local law as opposed to the current zoning law and ZEO denial
- enforcement of violations under the proposed law, civil verses criminal
- concern with property maintenance requirements in accordance with the Property Maintenance Code of NYS
The public information hearing on proposed Local Law No. 1 for the Town of Milford 2009 was closed at 8:50 pm.

The Public Information Hearing on proposed Local Law No. 2 of the Town of Milford for 2009 regarding amendments of the Town of Milford Zoning Ordinance was opened at 8:50 pm by Town Supervisor Thomas Gale. The Town Supervisor read proposed Local Law No. 2 and advised it would not be needed if proposed Local Law No. 1 was not passed. Planning Board Chairman Bruce Milavec corrected the definition of parking space, section 14c, stating the definition should match the definition in proposed Local Law No.1. Town Supervisor Gale made the change. Town Supervisor Gale opened the floor to discussion and there was none.
The public information hearing on proposed Local Law No. 2 for the Town of Milford 2009 was closed at 9:05 pm.
